Terms and conditions

For some reason most hosting companies like to hide their terms away somewhere quiet and often hard to find. We know it isn't the most exciting reading, but it is important for customers to know where we draw the line. We think it's a very fair line, but if you disagree please let us know - we're always open to suggestions!

Our terms of trading, and other important documents that govern the relationship between us and our customers are broken into a few sections, accessible from the menu on the left.

Some basic definitions

Where the context admits: "We" includes Ziphost or any party acting on ziphost's implicit instructions. "You" includes the person purchasing the Services or any employee acting on your instructions. "The Registrant" includes the person applying for a domain name or any party acting on the Registrant's instructions. "The Registry" refers to the relevant domain names Registry. "Server/s" means the computer server equipment operated by us in connection with the provision of hosting Services. "Web Site" means the area on the Server allocated by us to you for use by you as a site on the Internet. “Services”, more generally describes any work, products, or services we are providing to you.

Payment and customer verification

We ask customers to provide full business details when ordering hosting. Once verification of your identity is completed we will issue your invoice and open your account. We expect payment to be made within 14 days of any invoice for hosting. Failure to meet this request will result in suspension of your account - unpaid accounts suspended for 14 further days will result in termination and deletion of all data.

Domain Name Management

We make no representation that the domain name you wish to register is capable of being registered for you or that it will be registered in the correct name. You should therefore not assume registration of your requested domain name(s) until you have been notified that registration is complete and any action taken by you before such notification is at your risk.

The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant Registry; you shall ensure that you are aware of those terms and conditions and that you comply with them.

You shall have no right to bring any claim against us in respect of refusal to register, failure to maintain, or failure to renew, a domain name.

We shall have no liability in respect of the use by you of any domain name; any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel services. We shall also be entitled to make representations to the relevant Registry but will not be obliged to take part in any such dispute.

We shall not release any domain to another provider unless full payment for that domain has been received by us.

Where payment is not received in time for renewal, we will not be held responsible for a domain expiring, becoming detagged, or otherwise being made non-operational.

Website hosting and email

You shall observe the procedures which we may from time to time prescribe. You are solely responsible for ensuring that the content of your Web Site and it’s operation, including but not limited to the operation and use of all other functionality forming part of the Services, comply with any relevant legislation.

Data Security

You are responsible for the content of your account. This includes the responsibility to maintain your own backups - whether on your hosting account, via your contol panel, or off-site on your own storage. We are not liable in any way for the failure of live data, local backup data, or off-site backup data.

Limit of liability

Any service provided by Ziphost is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to: warranties of title, noninfringement, or implied warranties of merchantability or fitness for a particular purpose. At no time shall advice or information given by Ziphost, its agents or employees, constitute a warranty. Ziphost provides no warranty that the service will be uninterrupted or error-free, or that information or material accessible through the service is free from harmful components. Under no circumstances shall Ziphost be liable for any direct, indirect, special, punitive, or consequential damages that result in any way from use of or inability to use the service, or from mistakes, omissions, interruptions, delays of transmission, errors, deletion of files, misrouting of information, defects, or any failure of performance.

SSL Certificate Warranties

Any failure, mis-issuance or any other incident leading to a claim under the specific warranties issued with SSL certificates will be made directly to the Certificate Authority concerned. Ziphost will be held indemnified with respect to any and all such claims that may arise.
